Call for Comment: LSO's Competence Task Force Report
September 21, 2021
The CCLA is asking for your comments regarding the Law Society of Ontario’s (“LSO”) Competence Task Force Report: Renewing the Law Society’s Continuing Competence Framework (“Report”). The LSO advises that the Competency Task Force “was established to examine regulatory approaches aimed at ensuring and enhancing the post-licensure competence of lawyers and paralegals. The objective of the Task Force is to recommend an effective, proportionate, and balanced regulatory framework addressing career-long competence in a manner that protects the public interest and is responsive to the public’s legal needs." The Competency Task Force released its Report on June 23, 2021. The LSO states that the Report “details the Law Society’s mandate to regulate the competence of lawyers and paralegals and provides an overview of how competence regulation has evolved to keep pace with regulatory best practices. The Report also provides an overview of the Task Force’s work plan, a working definition of competence, and proposed themes and principles which may inform new approaches to competence programs and requirements.”
The LSO has issued a Call for Comment on the Report. Go directly to the Call for Comment. The LSO deadline for the Call for Comment is November 30, 2021.
You can provide your input directly to the LSO by following the above noted link, or you can share your input with the CCLA as we are preparing detailed submissions on behalf of our members and would like your input. The deadline to submit your comments to the CCLA at info@ccla-abcc.ca is November 1, 2021.
Following the conclusion of the LSO consultation, the Task Force will study the submissions and make recommendations to Convocation. We encourage our members to share their concerns, experiences and ideas to ensure that the Task Force has the benefit of a full range of options and approaches to supporting post-licensure competence.
Please note that the LSO has advised that it “has not made any decisions about the structure or content of an updated competence regime. [The LSO is] open to the suggestions and feedback of all interested parties and we encourage and appreciate your input.” The definition of competence within our profession and the manner with which that competence is maintained in the form of professional development requirements are critical aspects of our profession and ongoing self-regulation. We want to ensure that your voice is heard.
