<title>Family Court - CaseLines Update</title>

<description><![CDATA[<p>Please be advised that the Family Court will be expanding in the use of CaseLines for the following matters:</p><p><strong>Motions:</strong><br /><br />Starting <strong>June 6th/22 all scheduled motions will be using CaseLines</strong>. Administration staff will be providing invites to counsel and self-represented litigants. It’s important to note documents must be accepted and filed with the family counter in person or virtually prior to uploading to CaseLines. All filing in CaseLines must be uploaded 3 business days prior to your scheduled motion by 2:00pm.<br /><br /><strong>Case Conferences:</strong><br /><br />Starting <strong>July 4th/22 all scheduled case conferences will be using CaseLines</strong>. Administration staff will be providing invites to counsel and self-represented litigants. It’s important to note documents must be accepted and filed with the family counter in person or virtually prior to uploading to CaseLines. <title>Ottawa Civil Motions Update</title>

<description><![CDATA[<p>We wish to notify you of upcoming changes in the Ottawa Civil Court that are set to officially commence on <strong>June 6th, 2022</strong>.</p><p>Within the next two weeks, the Ottawa Courthouse’s Civil department will be transitioning to the use of CaseLines for all Motions and Applications. This update will be accompanied by the release and use of a new Confirmation of Motion form (37B) applicable to Ottawa only. In this form, parties will be expected to provide additional information related to their filing with the court and the intended upload of those same documents to CaseLines.</p><p>The Civil Court office will utilize the receipt of the new Confirmation of Motion form as the trigger to provide parties with their CaseLines link via email. It is important to emphasize that the filing of your documents with the court must occur prior to their upload to CaseLines, as the submission of documents to CaseLines alone does not constitute filing.</p><p>To further supplement the transition we have attached a copy of the new Confirmation of Motion form (<a href="https://www.ccla-abcc.ca/resource/resmgr/pp-civlit/2022may-37b-en.docx">English</a> / <a href="https://www.ccla-abcc.ca/resource/resmgr/pp-civlit/2022may-37b-fr.docx">Français</a>) and a <a href="https://www.ccla-abcc.ca/resource/resmgr/pp-civlit/2022maycivmotpam.pdf">reference pamphlet</a> that provides an outline of the timelines associated with the filing and upload of materials. As this new form and supporting documentation is applicable to Ottawa only it will not reflect on the “ontariocourtforms.on.ca” website. Instead, it will be made available on the County of Carleton Law Association Website (ccla-abcc.ca) on the Civil Litigation Practice Portal, and can also be requested through our Civil Court office by email, telephone or in-person.</p><br />]]></description>

<title>Statement of Principles: A Guide to the Application of Recommendation 3(1)</title>

<description><![CDATA[The CCLA would like to advise the legal community that the Law Society has just released its Guide to the Application of Recommendation 3(1) regarding the Statement of Principles contained in the Working Together for Change: Strategies to Address Issues of Systemic Racism in the Legal Professions report approved by convocation.<br />
<br />
The information below has been provided to licensees by the Law Society on November 21, 2017:<br />
<br />
The Recommendation is one of 13 approved by the Law Society to promote equality, diversity and inclusion in the legal professions following our findings of systemic racism in the professions.  The Statement is one aspect of raising awareness by asking all licensees’ to reflect on their existing obligations and special responsibilities to respect human rights laws. <br />
<br />
In light of the questions raised, the Law Society believes that additional clarification would be helpful. To that end, a <em>Guide to the Application of Recommendation 3(1)</em> has been developed.<br />
<br />
The Guide, which can be accessed <a href="http://trk.cp20.com/click/l0f32-cpq1tj-78foitf9/">here</a>, provides clarification on the intent of the Recommendation and addresses the concerns that some have raised that the Recommendation is “compelled speech,” or requires adherence to specific beliefs.<br />
<br />
The Guide states that the requirement does not carry any obligation to profess a particular belief, or seek to persuade anyone to believe in a certain point-of-view. Rather, it references existing legal and professional obligations regarding human rights and the prevention of systemic racism and discrimination, and makes clear that the Statement relates to a licensee’s professional conduct.<br />

There is an urgent need to take meaningful action to address systemic racism and discrimination against all equality-seeking groups in the legal professions. We thank you for your engagement on this issue and your contribution in helping the professions work towards ensuring a modern, responsive, and inclusive environment for all licensees.<br />

<title>New Rules Regarding Referral Fees </title>

<description><![CDATA[<p>On Thursday, Convocation of the Law Society of Upper Canada approved new rules relating to referral fees.  These new rules come into effect immediately.<br />
<br />
In summary, Convocation approved a cap for referral fees based on a percentage of the legal fee:  15% for the first $50,000 of legal fees and 5% of all legal fees thereafter, to an absolute cap of $25,000.<br />
<br />
Related measures to increase the transparency of referral fee arrangements were also approved, including:  <br />
<br />
</p>
<ul>
    <li>The client, the referring lawyer or paralegal and the lawyer or paralegal accepting the referral must sign a standard referral agreement, as provided by the Law Society (Click <a href="https://www.ccla-abcc.ca/resource/resmgr/news/Referral_Agreement_Form.docx">here for a Word version</a> of this agreement, and <a href="https://www.ccla-abcc.ca/resource/resmgr/news/Referral_Agreement_Form.pdf">here for a PDF version</a>.)</li>
    <li>The account to the client must clearly indicate the amount of the referral fee</li>
    <li>The client must sign an acknowledgement for the referral payment at the time the payment is made</li>
    <li>Lawyers and paralegals must record referral fees paid and received in their books and records and report on referral fee practices in the annual reports they submit to the Law Society<br />
    <br />
    </li>
</ul>
Convocation also approved:<br />
<br />
<ul>
    <li>Prohibiting up-front referral fees</li>
    <li>Continuing to prohibit paid referrals when the referring licensee has a conflict of interest</li>
    <li>Prohibiting the payment of referral fees to licensees whose licenses were suspended at the time of referral</li>
    <li>The requirements do not apply to enforceable referral agreements entered into prior to April 27, 2017</li>
</ul>

The cap and additional regulatory measures were recommended by the Law Society’s Professional Regulation Committee and the Advertising and Fee Arrangements Issues Working Group to address concerns that certain fee arrangement practices may be misleading or detrimental to clients. Convocation voted in principle to implement a cap and to further regulate referral fees at its meeting in February.<br />
<br />
The Working Group continues to consider related issues including advertising and fees in real estate and contingency fees and further action by the Law Society is expected on these areas in the coming months.

<title>Civil Claims Online Filing Service Pilot</title>

<description><![CDATA[<p>Ottawa has been selected to participate in a pilot project from the Ministry of the Attorney General that will allow for online filing for civil claims.</p>
With this service, you can submit these completed forms online:<br />
<li>Statement of Claim<br />
</li>
<li>Notice of Action<br />
</li>
<li>Affidavit of Litigation Guardian of a Plaintiff under a Disability<br />
</li>
<li>Request for Bilingual Proceedings<br />
</li>
<li>Consent to File Documents in French<br />
</li>
<br />
You can also pay court fees online securely by credit card and receive a court-issued Statement of Claim or Notice of Action by email.<br />
<br />
All other forms will continue to be filed in person at a courthouse. As this service expands, you will be able to file more documents online in all jurisdictions.<br />
<br />
If you file your claim on a weekday – between 8:30am and 5pm – you will receive an email from the court right away – unless an unexpected system outage occurs.<br />
<br />
This email will include your Statement of Claim or Notice of Action with an attached court seal, the assigned court file number and the date it was issued. The court seal means you can move forward with your claim.<br />
<br />
If you file your claim outside regular business hours, you will receive an email with your issued claim dated the next business day.<br />

<description><![CDATA[<p><strong>Message from the Law Society: Pathways Pilot Project Evaluation and Enhancements to Licensing Report&nbsp;</strong></p>
<p>The Pathways Pilot Project and evaluation were among the recommendations Convocation approved on November 22nd, 2012, following recommendations of the Articling Task Force Report. This Report provides the Committee’s analysis and recommendations respecting the pilot and also addresses recommendations the Committee made in April 2016 respecting enhancements to the licensing process.</p>
<p>The Pathways Pilot Project Evaluation and Enhancements to Licensing report will be debated by Convocation on November 9th, 2016. The Professional Development and Competence Committee welcomes written comments on the report from the professions until October 19, 2016.</p>

<p>Vous recevez à titre d’information, le Rapport d’évaluation et d’amélioration du projet pilote Voies d’accès à la profession du comité du perfectionnement professionnel (CPP).</p>
<p>Le projet pilote Voies d’accès à la profession et son évaluation faisaient partie des recommandations que le Conseil avait approuvées le 22 novembre 2012, à la suite des recommandations du Groupe de travail sur le stage.</p>
<p>Le présent rapport contient l’analyse et les recommandations du comité à l’égard du projet pilote et porte également sur les recommandations que le comité a faites en avril 2016 à l’égard des améliorations au processus d’accès à la profession.</p>
<p>Le Conseil débattra du Rapport d’évaluation et d’amélioration du projet pilote Voies d’accès à la profession le 9 novembre 2016. Les membres des professions peuvent envoyer leurs commentaires sur le rapport par écrit au comité du perfectionnement professionnel d’ici le 19 octobre 2016. </p>

<title>New Case Management Master Appointed in Ottawa</title>

<description><![CDATA[<span style="color: #606060;">A new case management master has been appointed to the Superior Court of Justice in Ottawa, effective October 19, 2016.<br />
<br />
<strong>Case Management Master Marie T. Fortier</strong>&nbsp;was called to the bar in 1983. Since 2012, she has served in a variety of adjudicative and quasi-judicial roles, most recently serving as a justice of the peace in the Ontario Court of Justice. Before that, she held the position of deputy judge of the Small Claims Court, associate chair of the Animal Care Review Board, and as a regional director of education with the Law Society of Upper Canada. Master Fortier litigated civil matters at all levels of Ontario courts, in both French and English in her previous career as a litigator in private practice.<br />
<br />
Case Management Master Fortier has been active in her community, providing legal guidance and leadership for local environmental, education, and sports organizations. She has also volunteered her time with local youth softball and hockey teams.<br />

have been made to Superior Court of Justice Practice Directions that will
impact family cases:&nbsp;</p><p>1. A new Family Practice Direction has been introduced for the East region
(<a href="http://www.ontariocourts.ca/scj/practice-direction-east/">http://www.ontariocourts.ca/scj/practice-direction-east/</a>).&nbsp;
As a result, family law provisions have been removed from the East region’s
regional Practice Direction.</p><p>2. Significant amendments have been made to the <a href="http://www.ontariocourts.ca/scj/practice/schedules/sw/">South
