Under the Personal Health Information Protection Act, and its regulation, BORN is Ontario's prescribed perinatal, newborn and child registry with the role of facilitating quality care for families across the province. BORN, acting as a prescribed registry, collects, interprets, shares and rigorously protects high-quality information essential to the understanding of and planning for better perinatal, newborn and child health in the province. As digital and secure data sharing technologies continue to improve, BORN Ontario is expanding its work to create and scale new digital health tools that can be used across the province.<br /><br />These tools will securely use trusted health data and evidence to support better care decisions and improve health outcomes for individuals and families. This work builds on BORN’s longstanding role in improving healthcare quality and equity by turning health system data into meaningful insights that support learning, improvement, and impact.</p><p>CHEO is seeking a Legal Counsel and Privacy Officer to join their legal team in support of the functions and strategies being developed and implemented across BORN Ontario and its Prenatal Screening Ontario program.<br /></p><p>You will be accountable for supporting the overall legal and privacy framework at BORN, while providing guidance on a broad and diverse mix of legal disciplines encompassing regulatory (compliance), corporate and commercial law and other matters as required by the management of BORN. This role reports to the Executive Director of BORN Ontario and requires a high degree of visibility and presence across the organization and with program and research partners across the province, with demonstrated skills in negotiation and execution to match.<br /><br /><strong><span style="text-decoration: underline;">MAIN RESPONSIBILITIES<br /></span></strong><br />Key functions for the Legal Counsel and Privacy Officer will include the following, all of which are in the context of providing direct support to BORN while doing so in the greater context of CHEO:</p><ul><li>Act as the legal counsel and information privacy advisor to the senior management of BORN on a multitude of issues and topics. This entails ensuring the needs of BORN are being met while being consistent with the principles and processes in place at CHEO.</li><li>Actively contributes to the development and implementation of a proactive legal framework, enabling opportunities to be realized for value-added legal service and guidance. This may include but is not limited to:<ul><li>monitoring relevant national and provincial legislation and regulation, providing briefings and analysis on applicability to BORN and CHEO’s health information operation,</li><li>providing detailed legal and privacy analysis and recommendations for new and emerging operations in digital health and information privacy that involve BORN Ontario and relevant programming at CHEO.</li></ul></li><li>Provide strategic and operational leadership regarding legal opportunities and challenges, strategic planning, and risk management.</li><li>Provide support and advice to the BORN privacy program, establishing and monitoring the implementation of policies, protocols, and appropriate internal controls for information privacy and security matters.</li><li>Liaise and interact with CHEO privacy professionals and with the Office of the Information and Privacy Commissioner as needed.</li><li>Continue to advance key stakeholder relationships with colleagues, hospital executives, and staff, and external partners to ensure collaboration, as well as alignment with the changing provincial health care landscape.</li><li>Negotiate, design, draft and/or review legal agreements, documents and contracts and either leads or assists with the negotiations with counterparties where clauses, stipulations or requirements are unacceptable.</li><li>Support risk‑based decision‑making for innovative technologies where legal and governance frameworks are evolving or unsettled.</li><li>Partners collaboratively with internal stakeholders to support complex digital health projects, offering mitigation strategies and alternates where appropriate to align with established risk tolerances.</li><li>Work closely with team members to create a service and performance delivery culture.</li></ul><p><strong><span style="text-decoration: underline;">QUALIFICATIONS</span></strong></p><ul><li>Law degree (JD or LLB) and member in good standing with the Law Society of Ontario (Essential)</li><li>Minimum 7 years of progressive legal experience in a complex, highly regulated environment (Essential)</li><li>Demonstrated expertise in Ontario health law and health information privacy (Essential</li><li>Highly-developed legal, risk management, and policy analysis skills. Pour ce faire, la personne doit veiller à ce que les besoins de BORN soient satisfaits tout en respectant les principes et les processus en place au CHEO.</li><li>Contribuer activement à l’élaboration et à la mise en œuvre d’un cadre juridique proactif, qui permet de saisir les occasions d’offrir des services juridiques et une orientation à valeur ajoutée. Il s’agit notamment, mais pas exclusivement, de ce qui suit :<ul><li>Surveiller les lois et règlements nationaux et provinciaux pertinents, fournir des séances d’information et des analyses sur l’applicabilité aux activités touchant aux renseignements sur la santé de BORN et du CHEO;</li><li>Fournir une analyse juridique et de protection des renseignements personnels détaillée ainsi que des recommandations pour les activités nouvelles et émergentes en matière de santé numérique et de protection des renseignements personnels qui font appel à BORN Ontario et à la programmation pertinente du CHEO.</li></ul></li><li>Assurer un leadership stratégique et opérationnel en ce qui concerne les possibilités et les défis juridiques, la planification stratégique et la gestion des risques.</li><li>Fournir du soutien et des conseils au programme de protection des renseignements personnels de BORN, en établissant et en surveillant la mise en œuvre de politiques, de protocoles et de contrôles internes appropriés pour les questions de protection des renseignements personnels et de sécurité.</li><li>Assurer la liaison et interagir avec les professionnelles et professionnels de la protection des renseignements personnels du CHEO et le Commissariat à l’information et à la protection de la vie privée, au besoin.</li><li>Continuer de faire progresser les relations des parties prenantes clés avec les collègues, les membres de la direction et le personnel des hôpitaux ainsi que les partenaires externes afin d’assurer la collaboration et l’harmonisation avec le paysage provincial en évolution des soins de santé.</li><li>Négocier, concevoir, rédiger ou réviser des accords juridiques, documents et contrats et diriger ou aider les négociations avec les contreparties lorsque les clauses, stipulations ou exigences sont inacceptables.</li><li>Appuyer la prise de décisions fondées sur les risques pour les technologies novatrices lorsque les cadres juridiques et de gouvernance évoluent ou ne sont pas réglés.</li><li>Collaborer avec les parties prenantes internes pour soutenir des projets complexes de santé numérique, en offrant des stratégies d’atténuation et des solutions de rechange, s’il y a lieu, afin de respecter la tolérance au risque établie.</li><li>Travailler en étroite collaboration avec les membres de l’équipe pour créer une culture de prestation de services et de rendement.</li></ul><p><strong><span style="text-decoration: underline;">QUALIFICATIONS<br /></span></strong></p><ul><li>Diplôme en droit (J.D.
